The Council of State cancels the award of the municipal swimming pool: "Yet another failure by Raggi"

The Garbatella swimming pool, managed by SS Lazio for decades, was at the center of a dispute.

The award of the Garbatella municipal swimming pool must be cancelled. This was decided by the fifth section of the Council of State, to which SS Lazio Nuoto, the company that had managed the facility for decades, had turned.

A long-standing story The municipal swimming pool, located between viale Giustiniano Imperatore and via della Villa di Lucina, was one of the first municipal sports facilities that the Five Star-led Capitol has banned. However, the procedure, due to the way in which it was written, was immediately challenged by the Biancoceleste club. According to Lazio Nuoto tended to reward the economic offer more than the sporting and social one. Aspects that are anything but secondary because, at Garbatella, the fortune of Lazio Nuoto was built: a reality that can display Olympic, European and national titles on its showcase. And which can also boast a Paralympic section of absolute importance in the Italian field.

The pool assigned to the SSD Maximo However, the Capitol has always defended its ban which ended up rewarding another company, able to give greater guarantees on an economic level: the Maximo SSD. This resulted in a popular uprising and a series of appeals initiated by Lazio Nuoto, which placed second in the race. The Capitol was however adamant and, despite the ongoing legal dispute, in front of dozens of citizens in protest, demanded delivery of the keys to the new dealer. He was entitled to it due to the result obtained with the Capitoline tender. Only, now, that award must be cancelled.

What the ruling provides "In acceptance of the ground of appeal proposed by SSD Lazio Nuoto - we read in the ruling published on 15 September by the Council of State - the award provision must be annulled and the exclusion of SSD Maximo a rl (to which the the plant had been assigned ed) by the tender procedure for violation of the art. 5 of the competition regulations". What that article provides is reported in the sentence itself. “The entrepreneurial group to which the company (SSD Maximo) belongs is, in fact, already the owner of two concessions for municipally owned sports facilities”. And therefore, we always read in the sentence "the award would lead to the acquisition of a third plant".

A historic victory “They have been three terrible years, which will remain in the history of our association. I don't remember in all these years so much unjustified fury against the biancocelesti colours. Now justice has finally put an end to this sad story" commented Massimo Moroli, the president of Lazio Nuoto. “An expensive legal battle, made even more difficult by the almost obstructionist attitude of Roma Capitale” commented the lawyer Daniele Sterrantino, satisfied because “our reasons were accepted and in particular the one which highlighted the circumvention of the rule desired by the same administration of not having a concentration of capital sports facilities in the same business entity. A rule desired in words - the lawyer remarked - but denied in facts".
